Board of Supervision poor relief appeals

The Board of Supervision was established under the 1845 Poor Law Act. One of its tasks was to hear appeals by paupers against inadequate poor relief granted by Parochial Boards. These appeals were recorded in the Board of Supervision minutes. Cases were often heard over an extended period. The minutes may contain a variety of information, including about other family members, medical conditions and other circumstances. For more information about these records, see here.

Sheriff Court paternity decrees

Single mothers often took the fathers of their children to court for child support. Such cases were known as filiation and aliment cases. The court could order the father to provide maintenance payments to the mother. If the mother won her case, the court would issue a decree, which would allow the mother to enforce payment of aliment. We have indexed all the records of such cases held by the National Records of Scotland from at least 1855 to 1880, and can provide digital images of the records. Rolls of Male Heads of Families

In 1834, the General Assembly of the Church of Scotland passed the Veto Act, removing the absolute right of landowners to appoint ministers to their parish. The Act gave male heads of families who were communicants with the parish the right to veto the appointment of a new minister if a majority of them objected. To this end, the Assembly instructed kirk sessions to draw up rolls of the male heads of families in each parish. We have transcribed the surviving rolls, and are publishing them here. They are significant as they pre-date the earliest nominal census, which took place in 1841.

Details: Mr Liston laid before the meeting a letter addressed to him by Mr John Inches at Pitmurthly, stating
''That he was advised last summer not to attend the Sacrament of the Lord's supper, on account of a false Report which was circulated in the Parish against him; But that as twelve months had elapsed and no accusation had been lodged against him, he hoped there was nothing to prevent him from coming forward at the approaching Sacrament.''
The Session having deliberated on this subject, was stated by some of the members, that the Parents of the woman with whom it was said Mr. Inches had been guilty, had told them that their daughter had, before her death, repeatedly said to them that Mr. Inches was the father of her child; That they never heard her accuse any other person as the father; and that they had no reason to doubt that Mr. Inches was the Father of the child. It was also stated that the person in whose service the mother of the child was, after she left Mr. Inches' service, had declared, that she had requested leave to go to Perth to meet Mr. Inches, to inform him that she was pregnant to him. Under these circumstances, the session do not think they should be justified in admitting Mr. Inches to the privileges of the Church, until he shall satisfy them of his innocence. In the meantime, the Session direct that the East Church session of Perth be requested to cause summon William Gelletly, Labourer residing at Craigie; Elisabeth McGregor, his wife and Ann Gelletly, his Daughter, to appear before the Kirk Session, on Sabbath, the 22nd day of July current, to give evidence to these facts. And the Session direct Mr. Inches to be summoned to appear before them on the same day, the Session desired their clerk to answer Mr. inches letter by sending him an Extract of the minutes of this meeting.'

Compeared Hugh McColl, aged seventeen years, and being solemnly sworn, and purged of malice and partial counsel, Deponed that he knows the parties; That he saw them together at Balinblair wood, on an afternoon, during the turnip sowing season, last Summer; That he passed them while standing together at the edge of the wood; and that after he had passed them, he heard James Keay say to Margaret Lennie that he would come over some night this week to see how she was. Details: At Stanley, the Eight day of August Eighteen hundred and thirty two years, At a meeting of the conjoined Sessions of Auchtergaven and Redgorton, called on purpose to consider some irregularities that have taken place, connected with the Chapel of Ease belonging to the two Parishes, Sederunt The Revd Thomas Nelson, Minister of Auchtergaven, and Messrs Andrew Aitken, and Thomas Douglas, Elders of that Parish - and The Revd William Liston, Minister of Redgorton, and Messrs James Wilson, and James Roy, Elders of that Parish. Mr Liston was chosen Moderator, and Mr Wilson, Clerk.
It was stated to the meeting that many children had been baptized in the Chapel, whose names had not been Registered in their respective Parochial Registers, and without previous knowledge of the Elders of the respective Districts in which their parents were residing. The meeting unanimously resolved that in future, no child shall be christened in the Chapel of Ease, whose name has not been registered in the Parochial Register, and proof thereof produced to the officiating Minister - and without the Elders of the respective Districts being acquainted therewith.
It was also stated to the meeting that there had been some irregularities, and complaints with regard to the admission of the Lord's Supper. The meeting considering that by the 9th Clause of the constitution of the Chapel of Ease, it is declared, that the Minister thereof shall have power to admit the people to sealing Ordinances on certificate of moral character from the Kirk-sessions of their respective Parishes. And that by the Twelfth clause of the said constitution, it is expressly provided, that communicants are to be admitted to the Lord's Supper by the Elders of their respective Parishes - Therefore the meeting resolve that no persons shall hereafter be admitted to the Lord's Supper without receiving Tokens in the presence of, or by the express permission of the Elders of the Parishes to which they belong -
It was then stated to the meeting that stranger Elders had been brought to assist at the dispensation of the Lord's Supper without the knowledge or concurrence of the Elders connected with the Chapel; The meeting resolve that hereafter, the Elders acting in the District of Stanley, shall be previously consulted as to what stranger Elders shall be asked, or permitted to officiate at the ordinance.
The meeting also resolved that when communicants have left the place, they have been frequently furnished with Testimonials, signed by the Minister of the Chapel, and an Elder only - without the knowledge or signatures of the Session Clerks of the respective Parishes in which they resided. The meeting declare that the Minister of the Chapel of Ease has no right to grant such Certificates, without the signatures of the Session Clerks; and that he be prohibited from giving such certificates in future.
For the further remedy of the evils mentioned above, the meeting request the Elders to endeavour to obtain a Copy of the Constitution of the Chapel of Ease to be written in a Book, in which shall also be engrossed, the above Resolutions of the conjoined meeting; and that said Book; and that said Book [repetition sic] shall ly [sic] in the Session House of the Chapel of Ease for the inspection, and reference to, of all parties concerned.

Interalia, there was laid before the Session, a remit from the Kirksession of Redgorton, requesting James Nichol presently residing in this Parish to be cited before them, for the sin and scandal of fornication laid to his charge.
Eodem die, et loco, the said James Nichol having voluntarily compeared, and being solemnly admonished and interrogated he acknowledged being guilty of uncleanness with Amelia Bell, presently, or the, residing at Pitcairngreen, Parish of Redgorton, and confesses himself the father of her child. The above minute being read over to James Nichol, and being again interrogated, he adheres to his confession. Whereupon, being suitably rebuked, and having satisfied the Church, he was absolved from Censure. Extracted from the Record of the Kirksession of Strathdon, this 7th day of October 1832 by (Signed) John Kellas, Sess.Clk.''
The Session having taken this case into consideration; and considering also that Amelia Bell has applied for aid to her child, or for assistance or direction, how to obtain relief from James Nicol; and also that James Nicol does not belong to this Parish, but to the Parish of Auchtergaven, the Session are of opinion that it is more properly the province of that Parish to give her what aid or direction upon the subject she may require: and agree to grant her an Extract of this minute.'

And being further examined Depones That he cannot swear that Jean Stoddart made a present of a Gown to Christian McIntosh, but that his wife cut out a Gown for Jean Stoddart, the week before he was last examined; That there were two Gowns in the piece that was in Jean Stoddart's possession; That when he came to the Session, he saw a Gown of the same pattern on Christian Macintosh; That whenever he saw it, it occurred to him that it was Jean Stoddart's Gown. That he said so to his wife immediately when he went home; That when he first suspected Jean Stoddart to be with child he said to her, ''Jean I doubt there is something here with your foolishness, I wish there may not be a young Lowrie here.'' To which she answered, ''What have, you, or any other body to do with that, if he and I are satisfied.''

Compeared Alexander Reoch, and, being solemnly sworn, and purged of malice and partial counsel, Deponed, That he once saw Jean Stoddart, and Sandeman Stewart together after it was dark, standing beside an old Straw Stack at the back of James Cameron's house, at Pitcairgreen; That he saw Jean Stoddart next day, and said to her, ''Jean, you are looking very detached like to-day, I dread Sandeman has given you your Corn last night,'' At which she laughed and made no reply; That he, the Deponent, happened to be at Cromwellpark that same day, and saw Sandeman Stewart, to who he said, ''Sandeman, Jean says that she and you were too throng last night'' To which Sandeman Stewart replied, ''By my faith she surely did not tell you that. '' That this was in the month of April last; and that all this is truth.

Compeared Catherine Watson, and being solemnly sworn, and purged of malice and partial counsel, Deponed, That she was one day lately in James Clark's house at Cromwellpark, where two men were drinking; That she did not know them, but thought that one of them was Sandeman Stewart - and being desired by the Moderator to look at Sandeman Stewart, now present, she depones that he was not one of them; Depones farther, that she said while in James Clark's house as aforesaid, and in presence of said two men, ''Is that the father of Jean Stoddart's bairn'': to which, the man whom she supposed to be Sandeman Stewart, replied, He was: That Mrs Clark said to the Deponent, afterwards, that the man who answered that he was the father of the bairn, was Sandeman Stewart; But that she (the Deponent) now sees that it was not him; and all this is truth (Signed) Cath. Compeared again Alexander Reoch, who being further examined, Depones, that he said to Sandeman Stewart, after it became evident that Jean Stoddart was pregnant, ''I dread you are in for it'' which he denied; That he (deponent) ask him, if he did not pannell [def: formally accuse usually in court] with it four months ago - to which Stewart replied that before he would take it, ''he would cut his stick.''
Compeared William Fleming, and being solemnly sworn, and purged of malice and partial counsel, Depones that Alexander Reoch, and his wife Christian McIntosh, were living at Stanley from Eighteenth to Twenty first of February, 1831; That he knows Alexander Reoch was living in the town of Stanley at that date, for he was frequently in his (Deponent's) Bakehouse at Seven O'Clock in the morning; and that Alexander Reoch's wife frequently came to the Bake House for her husband; and that all this happened in the month of February 1831: and all this is truth.

Compeared Ann Black, and having been solemnly sworn, and purged of malice and partial counsel, Deponed that one night some weeks before Old handsel Monday last, Christian MacIntosh told Deponent, in Deponent's own house, that Jean Stoddert had shewn her child's clothes to her (Christian Macintosh) and had told her who was the father of the child - that it was Sandeman Stewart whom she stated to be the father; That she, Christian Macintosh, then said to Jean Stoddart, that Lawrence Taylor was the father, and no one else, for there was not another man near her at that time - and that Jean Stoddart still maintained that Sandeman Stewart was the Father. That Christian Macintosh said further to Deponent, that if Stoddart could not get peace in her father's house after the birth, she was to coom to a room beside her (Macintosh) and that if Stoddart was not to get leave to nurse her child, she (Macintosh) was to keep her milk to nurse it, and that she would be well paid for it. That she (Macintosh) said farther to Deponent ''Don’t you think this is a better way than to give the Child to Laurence Taylor, which would hurt the feelings of Catharine Imrie (his wife). Depones that Alexander Reoch sometime before Old Handsel Monday last, said to deponent, that he supposed the child was got in her, the Deponent's house - to which Deponent answered, that she thought it was got in his (Reoch's) house: That he said it would come to the first of the Hazels, for that if he were to put it to Laurence Taylor, he could not deny it; and all
