Board of Supervision poor relief appeals

The Board of Supervision was established under the 1845 Poor Law Act. One of its tasks was to hear appeals by paupers against inadequate poor relief granted by Parochial Boards. These appeals were recorded in the Board of Supervision minutes. Cases were often heard over an extended period. The minutes may contain a variety of information, including about other family members, medical conditions and other circumstances. For more information about these records, see here.

Sheriff Court paternity decrees

Single mothers often took the fathers of their children to court for child support. Such cases were known as filiation and aliment cases. The court could order the father to provide maintenance payments to the mother. If the mother won her case, the court would issue a decree, which would allow the mother to enforce payment of aliment. We have indexed all the records of such cases held by the National Records of Scotland from at least 1855 to 1880, and can provide digital images of the records. Rolls of Male Heads of Families

In 1834, the General Assembly of the Church of Scotland passed the Veto Act, removing the absolute right of landowners to appoint ministers to their parish. The Act gave male heads of families who were communicants with the parish the right to veto the appointment of a new minister if a majority of them objected. To this end, the Assembly instructed kirk sessions to draw up rolls of the male heads of families in each parish. We have transcribed the surviving rolls, and are publishing them here. They are significant as they pre-date the earliest nominal census, which took place in 1841.

The Session having examined the said Janet McLeod and taking into consideration that by the examinations formerly instituted the said Duncan Bethune was pronounced by the Kirk Session father of the illegitimate child born by her about five years ago and now being with her mother at Ellanreoch, he having acknowledged guilt with her within eleven days of the time, which corresponded with the birth of the child. The Session see no cause for altering the decision formerly pronounced in this case, finding Duncan Bethune to be the father of said child. And order extracts to be given accordingly.

Details: Samuel McPhee Cossack accused by Duncan Campbell as per last minute being called compeared and being interrogated acknowledged that he was guilty of the offence charged in as much as he did destroy three of the said Duncan Campbell’s buoys, this being done when he was under the influence of much anger as his own ropes and buoys had been taken away, by which he was prevented going to fish and he suspecting that the said Duncan Campbell had been the person to take them. The Session considering the grossness of the offence, rebuked and solemnly warned the said Samuel McPhee to be upon his guard against the influence of a passion which so far blinded him to his duty. Details: It having been reported also that on the occasion of a funeral which took place lately very improper and indecent conduct was exhibited by certain parties who attended it inasmuch as they quarrelled and fought and this too not being a solitary instance of the same kind, the Session resolved to go into it with the view of checking such an evil in future. After a lengthened and particular examination into facts it was evident that a scene of shameful disorder and drunkenness had occurred on the occasion of the wife of Duncan McLeor weaver Bernera, that the principal offenders in the quarrel were John Cameron, Malcom McCuaig and Angus Cameron. The session agreed to represent to these parties solemnly the grossness of their offence and to rebuke them for their conduct. And resolved to fine them as follows for the behoof of the poor of the parish; John Cameron One Guinea, Malcom McCuaig one guinea, and Angus Cameron in the expence of the damage done to furniture and windows, estimated by a Tradesman at six shillings and sixpence. Details: It having been reported to the Kirk Session that an instance of gross profanation of the Lord’s Day has recently taken place within the grounds of the Parish in as much as several young men in Kirkton did employ this day in hunting sheep in the hills for the purpose of selecting those which they conceived to belong to themselves or parents, the Kirk Session resolves to take up the case, seeing that this is not a solitary instance, and that it is high time that steps be taken to prevent a practice so full of evil.
The offenders in the present case are reported to have been Hugh Cameron, son of Widow McPherson, Kirkton, Malcom McLeod, son of Alexr Mcleod, Kirkton, Donald Morison, son of Alexr Morison, Kirkton, and Alexr Campbell, son of John Campbell Correry. The offence took place on Sabbath the 14th October last. The Session resolved to summon the said parties to appear at their next meeting and considering that they have already refused to attend to a message this day sent them to appear before the Session, the clerk is hereby directed to furnish the Beadle with written summonses setting forth the crime wherewith they are charged. And he is also directed to instruct the Beadle to request their parents to attend at same time. The Session also agree to summon Donald son of Finlay MacRae Kirkton, he being acquainted with the circumstances. The Summonses being delivered so that the parties may have ten free days notice.

And Donald Matheson was allowed to name witnesses in defence, when he gave the names of Angus McKinnon, Galder, Norman Fraser, Barracks, Donald McLeod, Widow Nixon and Finlay McCaskell, Kirkton. All which were ordered to be summoned to appear at the next meeting of Session, and the Parties themselves, the said Donald Matheson and Donald Morrison, summoned apud acta to appear at the same time.'

Details: The Session then proceeded to call before them in terms of Minute 21st Feb last, Donald Matheson, Gaelic Schoolmaster, and Donald Morrison, both residing at Galder, when the former appeared, and stated that he had, during the interval since last Meeting of Session, brought the matter between him and Donald Morrison before two Justices of the Peace, whose certificate he laid on the table. As this certificate bears that the charge against Matheson by Morrison had been examined into, and disproved by the oaths of the witnesses examined, and also, as it acquits him of other charges brought against him by Dugald McPhee, Galder, and John Campbell, Buorblich, and states the conviction of the Justices that the said Matheson’s character remains untouched, the Session see no cause, after this their minute, for going further into the case. Morrison did not appear and there was no appearance for him.

The said Ewen Cameron and Malcom McLeod having ingenuously acknowledged their guilt and expressed much regret for having fallen into the sin charged against them, the Session agreed to warn them solemnly of the evil of which they have been guilty and to rebuke them for the same, which was accordingly done. And they were dismissed, but summoned apud acta as witnesses against Donald McRae and Donald Morrison, who have not compeared and who are accordingly ordained to be summoned to next meeting of Kirk Session, Donald McRae being accused of Sabbath breaking equally heinous with that of which the other parties have been accused and on the same day.
