Board of Supervision poor relief appeals

The Board of Supervision was established under the 1845 Poor Law Act. One of its tasks was to hear appeals by paupers against inadequate poor relief granted by Parochial Boards. These appeals were recorded in the Board of Supervision minutes. Cases were often heard over an extended period. The minutes may contain a variety of information, including about other family members, medical conditions and other circumstances. For more information about these records, see here.

  • £3 for a single minute
  • £6 for up to 3 minutes for a single case
  • £9 for any single case with more than 3 minutes (some cases have as many as 8 minutes)

Sheriff Court paternity decrees

Single mothers often took the fathers of their children to court for child support. Such cases were known as filiation and aliment cases. The court could order the father to provide maintenance payments to the mother. If the mother won her case, the court would issue a decree, which would allow the mother to enforce payment of aliment. We have indexed all the records of such cases held by the National Records of Scotland from at least 1855 to 1880, and can provide digital images of the records. Rolls of Male Heads of Families

In 1834, the General Assembly of the Church of Scotland passed the Veto Act, removing the absolute right of landowners to appoint ministers to their parish. The Act gave male heads of families who were communicants with the parish the right to veto the appointment of a new minister if a majority of them objected. To this end, the Assembly instructed kirk sessions to draw up rolls of the male heads of families in each parish. We have transcribed the surviving rolls, and are publishing them here. They are significant as they pre-date the earliest nominal census, which took place in 1841.

Declares that the only reason he knows for the woman naming him as the father, is, that happening to be a little tipsy one night, he say Thomas Henderson who was jesting him on the subject, that if she gave the child to him he would take with it - little thinking that he was already named as the father.
Ann Honeyman being then called, her father compeared and stated that in consequence of having lately been confined, she is unable to attend this meeting and that she wishes James Porter, Crook of Devon, added to the list of witnesses formerly named on her behalf.
The Session delay the father consideration of this case, until they find that the woman be in a situation to attend the Session.'

James Porter, a Widower, aged forty years, and upwards, one of the Witnesses in this case being called compeared, and being warned by the Moderator to tell the truth as if upon Oath, and interrogated, declares, that he has put it to David Morison whether he is the, father of Ann Honeyman's child and that David answered that he would never deny it, nor would let the name of Davie Bath go down, that he said this at Witness's own fire side. And he has said the same thing in Witness's house frequently, And in presence of Witness's daughter and nephew, that the last time that he said the above to witness - Witness thought him the worse of drink but that at other times he has said the same thing to witness when quite sober.

Compeared Isable Porter, daughter to the preceding witness aged seventeen years, and being warned to tell the truth as if upon Oath, and interrogated declares that she has heard David Morison say that he would take with Ann Honeyman's child if she gave it to him - that if it was a Boy he would want to keep it himself - and that if it was a Girl, he would give it to his mother - that people has said that he was not able to get a child but he would shew them that he was, - that Witness heard him say the above in the house of Sophia Nicoll in presence of said Sophia Nicoll and Janet Moir - that when he said the above he did not want drink, but Witness thinks that he knew perfectly well what he was saying - and that this is all that the Witness knows in the business.

Compeared Helen Taylor a Widow, aged thirty years and upwards, and a witness in this case, and being warned to tell the truth as if upon Oath, and interrogated - declares - that she was coming about, she thinks the first of March by Vicar's Bridge, and came opposite to men about to yoke their plough - that this was a Tuesday or a Wednesday -and between Vicar's Bridge and Blairngone - does not think that the men saw her on account of a hedge being between them - that at this time she did not know who the men were - that she heard the one of them addressing to the other very unbecoming language, and having heard him mention ''Tulliallan'' she stopt to hear what he has to say about it, when she heard the mention of Jean Hutson's name- that she heard he and him say to his neighbour that he had been guilty with Jean Hutson in language too indecent to repeat, that he had heard she was with child, but that he would not take with it. That Declarant then adresses the man and said ''Do you not think shame to speak such unbecoming language on the side of a public road and people passing hearing you [''] - that he stood and looked now the hedge, when Declarant farther said - Do you know that Tulliallan people are so near, you - that he then said with an oath that they were all bad women in Tulliallan - that witness said - if they were bad, that he had made some of them so.- that he then said to Witness that he had been guilty enough with Jean Hutson, and that he was going that night to be as guilty with her as before, that Witness told him that she would tell Jean Hutson's parents and that he said he would do for Witness, if she told any thing that had passed - that when Witness had left the men a little space, she saw a woman coming with stoups to a well - that she asked the woman who the young man next her was - and was told - Joseph Hunter - that witness farther asked - who was his master - and was told Alex. Penny - she farther asked - who was the man beside Hunter - and was told William Todd - that witness then mentioned to the woman what she had heard Hunter say - and while in the presence of the woman - she called aloud to Hunter that she had found out who he was, and that she would tell Jean Hutson's parents.- that Hunter then answered, that witness would not better tell what had passed - that witness has no doubt that she would know Joseph Hunter again, as from the particular circumstances she had taken a particular look at him. That witness declare she cannot write

The Session appoint their Clerk to write to the minister of Saline requesting him to cause William Todd to be cited to attend the Session here on Sabbath next - and John Hunter, mason, Blairngone is directed to be summoned to attend at same time. The Session also appoint Mr Fife to apprise Joseph Hunter of this resolution of Session in order that he may attend for his interest if he shall see cause and Jean Hutson is summoned apud acta to be present.'

John Hunter summoned as an evidence in this cases being called - compeared - and being warned to tell the truth, as if upon oath, and interrogated - Declares - that he is about nineteen years of age and unmarried - that he heard Joseph Hunter, say to Jean Hutson, that if she would give her child to another, he would marry her as soon as she got quit of it - and that Jean Hutson said - that she could not do that.- that Joseph Hunter and Declarant went to Kincardine together - that Declarant called upon Jean Hutson at her father's house for old acquaintance sake - that Declarant asked Jean Hutson to go with him to a public house - that Joseph Hunter joined them on the street, and went along with them - that when in the public house Declarant asked Jean Hutson whether the report was true that she was with child - and that Jean Hutson said that it did not become him to ask that - to let Joseph ask that himself - that this lead to what Declarant has already stated viz. that Joseph Hunter said, he would marry her if she would give the child to another - that when Declarant, Joseph & Jean went out of the public house Jean told Declarant that Joseph had offered her One Pound - in case she would give the child to another -. that Joseph had made this proposal when Declarant was out of the room lighting his pipe. Being farther interrogated - declares - that Joseph and Declarant first went into the public house - that Declarant then, with Joseph's concurrence, sent a Girl to ask Jean Hutson, but that she would not come to them - that Declarant then went to Jean's father's house himself leaving Joseph Hunter on the street, and declares that this is all he knows of the matter.

Compeared William Todd another evidence summoned in this cause - aged Twenty years and upwards and married - and being interrogated - Declares that he has heard Joseph Hunter frequently say that he had been guilty with Jean Hutson more than twenty times, and that he made a boast of his having done so - that Declarant has heard him say this both before and after Declarant's marriage - that Declarant remembers of Joseph Hunter speaking of his guilt with Jean Hutson one day when they were working their ploughs, working their ploughs when a woman happened to be passing on the road - that the Declarant afterwards learned the woman was from Tulliallan - that the woman spoke to Joseph Hunter, who afterwards told Declarant that the woman said to him, that he had better take care that she doubted he had been guilty with Jean but too often already - that just as the woman made her appearance Joseph Hunter told Declarant that he understood that Jean Hutson had come from Kincardine, and that he would get tonight what he had got before - that Joseph Hunter told Declarant that he said to the woman that if Jean Hutson was with child that he would take with it.
