Board of Supervision poor relief appeals

The Board of Supervision was established under the 1845 Poor Law Act. One of its tasks was to hear appeals by paupers against inadequate poor relief granted by Parochial Boards. These appeals were recorded in the Board of Supervision minutes. Cases were often heard over an extended period. The minutes may contain a variety of information, including about other family members, medical conditions and other circumstances. For more information about these records, see here.

Sheriff Court paternity decrees

Single mothers often took the fathers of their children to court for child support. Such cases were known as filiation and aliment cases. The court could order the father to provide maintenance payments to the mother. If the mother won her case, the court would issue a decree, which would allow the mother to enforce payment of aliment. We have indexed all the records of such cases held by the National Records of Scotland from at least 1855 to 1880, and can provide digital images of the records. Rolls of Male Heads of Families

In 1834, the General Assembly of the Church of Scotland passed the Veto Act, removing the absolute right of landowners to appoint ministers to their parish. The Act gave male heads of families who were communicants with the parish the right to veto the appointment of a new minister if a majority of them objected. To this end, the Assembly instructed kirk sessions to draw up rolls of the male heads of families in each parish. We have transcribed the surviving rolls, and are publishing them here. They are significant as they pre-date the earliest nominal census, which took place in 1841.

Details: Extract of the late Rev.d James Adam's Will: ... The moderator stated that he had received from the Trustees of the late Rev Mr Adam the sum of Forty Five Pounds Stirling being the remainder of the Fifty pounds Stirling left by Mr Adam to this Session after paying the legal dues of ten per cent to the exchequer, together with an extract of his Will as far as regards said sum which sum being paid over to the Treasurer, the Session appointed the said extract to be engrossed in their minutes which is as follows; We the Minister and Kirk Session of the Kirk of Cumbray considering that the now deceased Revd. James Adam Minister of the Parish of Cumbray by his trust disposition and settlement dated the 16th day of June 1825 and Registered in the sheriff Court Books of Buteshire the 28th day of April last Legated and Bequeathed to us the Minister and the Kirk Session of the said Parish of Cumbray for the time Fifty Pounds Stirling to be lent out or secured as they might consider proper and the interest or annual rent thereof to be applied by the minister and Kirk Session of said Parish of Cumbray for the time, in educating three or four children natives of or belonging to that Parish for the period of three years each, and after that period other children selected by the Minister and the Kirk Session of the said Parish of Cumbray for the time to receive the same benefit for a like period such children always being natives of or belonging to that Parish and son on thereafter in time subsequent to be paid at the first Whitsunday or Martinmas which should happen six months after decease and seeing that Messrs. John Adam Bleachers sometime of Burnbank, now at Millbank near Glasgow and John Duncan Baker Irongate Glasgow and Duncan Smith sometime soda and candle maker now merchant in Glasgow trustees and executors of the said James Adam have made payment to us of the foresaid sum of Fifty Pounds Stir[lin]g therefore we have exhonored and discharged the said John Adam, John Duncan, and Duncan Smith as Trustees and Executors foresaid, their Heirs and executors and successors and all other representatives of the said James Adam of the foresaid sum of Legacy contained in and due by the said disposition and settlement together with the said settlement itself in as far as the same relates thereto and of all action and execution competent or that may be competent to follow thereon which discharge we hereby bind and oblige the said Minister and Kirk Session of the said Parish of Cumbray for the time to warrant to said Trustees and executors and the foresaid, and all others the Representatives of the said James Adam at all hands, and against diddling in laws will. In witness whereof these presents written by Archibald Walker Clerk to Alexander Irvine Writer in Rothesay are subscribed at Glasgow the 22nd day of May 1832 before these witnesses. The Moderator stated that John Paton presently residing in this parish had called upon him some days before with a petition in which he requests a Sessional certificate of Poverty to enable him to appear by Agent, in a Court of session as prosecutor against Mr Wilson of Hailie for some alledge[d] debt. They agreed to take the said petition into consideration at the their next meeting, which they appoint to be held in the Kirk on the 12th current and direct that the said John Paton be requested to attend and also that he previously to the meeting of Session give due intimation to Mr Wilson of Haillie in order that he also may attend the said meeting of Session for his own interest.'

Details: Paton compears gives in a petition: ... Compeared John Paton mentioned in the minute of last meeting and gave in a petition craving that the Court may be pleased to issue the necessary Certificate of Poverty in order that he may be admitted to the benefit of the Poors Roll in the Court of Session and therby be enabled to vindicate and support his civil rights. Compeared also Mr Fulton agent for Mr Wilson of Hailey requesting to be heard. The session declined hearing Mr Fulton and same time expressed their willingness to propose any question to John Paton that he might suggest for the purpose of eliciting the true statement of his circumstances. The Session the proceeded to the examination of the said John Paton, when the following questions were proposed to him.
Are you John Paton possessed of any Lands Heritages Bonds Bills Furniture, debts &c &c? To which questions he answered in the negative. But farther specially interrogated he admitted that in making over his whole heritable property to his son John Paton Writer in Greenock which sum of £30 $$$ is payable to him quarterly and that the last quarterly payment was received by him on the 12th day of May 1832 and that the next payment will be due in August next. He was farther asked[.] Are you John Paton willing to assign the Bond which you hold on your said son John Paton to Mr Wilson of Hailey in security of course at the court of Session, should be process instituted against him by you? To which question he answered in the negative.
The Session considering the petition and the answers given by the petitioner to the foregoing questions unanimously agreed to grant him a certificate as follows.
We the undersigned Minister and Elders of the Parish of Cumbray, do hereby certify that on the twelfth day of June Eighteen hundred and thirty two John Paton residing in Millport applying for the benefit of the Poors' roll in the Court of Session to enable him to advocate a process at his instance from the Sheriff Court of Ayrshire to the Court of Session as also institute a Summons of Reduction before the Court. Appeared personally before us and did in our presence emit the following statement in regard to his circumstances and situation.
That he is seventy two years of age. That he has resided in Millport for these three years past, having previously to coming there resided in Largs for several years and prior thereto for many years in Greenock where he followed the profession or employment of a Messenger at Arms and that of an Auctioneer. That he has been forty four years married. That he has one son and two daughters the youngest of whom is about seventeen years of age, is in some measure dependent upon him for support. That he was born in the Parish of Largs. That he has been confined to the house for these two years past and is at present suffering from extremes of poverty. That he is not possessed pf any Land Heritages Bonds Wills or Debts or other effects. That the declarant has not at present any other lawsuit depending before the Court of Session or any other Court excepting the Process before mentioned. Paton's Certificate: We further Certify that the credit of the foregoing statement depends exclusively on the applicant himself:- But on examination , he admits that he has an Annuity of thirty pounds Stirling during his life which he reserved to himself upon conveying property to his son John Paton Writer in Greenock which Annuity has hitherto been paid to him and is payable quarterly. That the last payment was received by him at Whitsunday eighteen hundred and thirty two and the next payment will be due in August next. That he is not willing to assign the security which he holds for said Annuity to Mr Wilson of Hailey in security of the expences of any proceedings which may be instituted against him before the Court of Session. The Session after considering the above mentioned letter and accompanying Certificate to unanimously resolve to adhere to the former Certificate issued by them, - decline making the addition required by Mr Wyllie and appoint the Moderator to signify this by letter''

Execution of Intimation to James Wilson Esquire Hailey.
Petition of John Paton to the Minister and the Kirk Session of Cumbray.
Petition to the Court of Session for the benefit of the Poors Roll.
Remit of the Court of Session instructing the Kirk Session of Cumbray to enquire into the credibility and circumstances of the said John Paton and to Certify accordingly.
The Session agreed to take the above papers into consideration at their next meeting which was appointed to be on the 19th current.''

Details: ' Session resume consideration John Paton's Certificate: ... The Session having taken into their consideration the papers mentioned in last minute unanimously agree to add the following clause to the certificate formerly granted to John Paton.
Having resumed consideration of the foregoing declaration by the Applicant John Paton together with the remit made to us by the court of Session of the date the 30th ulto. To enquire into the credibility and circumstances of the said John Paton, we do hereby Certify that we have made the enquiry required of us - that with the exception of the Bond for Thirty Pounds referred to in the foregoing Certificate, we have not been able to discover that the petitioner has any other means of subsistance - that from the circumstances of his having concealed from us fact of his being possessed of the income derived from the said Bond until specially interrogated by us after emitting the first part of his declaration - and that from his having declared that he was confined to his house for two years while we had personal knowledge that he was not confined to his house for any thing like that period, we cannot certify that he is a person of credibility.
